Over the last 25 years, our firm has evolved to meet the increasing complexity of litigation itself, the industry, and the developing expectations of our society. Not only does Evans, Philp LLP provide exemplary representation for our clients, but we are also dedicated to maintaining an expansive knowledge of the issues affecting our clients. Similarly, while centred in Hamilton, we have long provided defences across Ontario – developing expertise and experience with the local circumstances of the adjudicators, juries, and counsel.

We are pleased to provide legal services tailored to the developing needs of our clients. This is reflected in our longstanding relationships as external counsel for national and international insurers, in limited case-specific roles where local specialization is needed, and all manner of commitments in between. This includes a history of working with American insurers that require Ontario representation. Not every matter can be negotiated – and we have the experience to try those matters where principle calls for it. Change does not stop. The pandemic was a clear example, as the courts and tribunals faced an unprecedented challenge. As a firm, Evans Philp was already fully functional to meet the requirements of electronic files. This allowed for a notable number of trials and tribunal hearings to be heard from 2020 on. The experience built up has already served our clients well in the present era of hybrid adjudication. 

In an era that requires increasing specialization, we offer civil litigation services through two distinct teams of legal professionals: the accident benefits group and the tort group.

Accident benefits

Evans Philp’s dedicated Accident Benefits Group advances our clients’ interest through tribunal litigation and private arbitration on all matters involving Ontario’s no-fault regime, including benefit disputes, priority and loss transfer questions, and coverage issues. As one of the largest practice groups in Ontario committed exclusively to Accident Benefits law, we are positioned to provide clients with a high level of knowledge, experience, and competency.

Our lawyers appear frequently before the Licence Appeal Tribunal and regularly handle matters through Reconsideration and Appeal processes. Our practice is supported by highly capable and dedicated clerks and legal assistants who ensure that matters are handled attentively and efficiently for our clients.

Our lawyers are known for their ongoing contributions to the legal landscape in this area and regularly present at industry seminars. An emphasis on internal collaboration and mentorship allows us to provide clients with legal advice and representation informed by a depth of experience and institutional knowledge.

Tort

Evans Philp’s dedicated Tort Group litigates in a wide range of matters across Ontario, including all manner of personal injury claims, product liability, fire and property claims including fraud, professional negligence, institutional defences, and quasi-criminal matters. The group benefits from extensive experience at all levels of court, as well as with alternative dispute resolution and specialized tribunals. This expertise is a shared strength: our students and associates are involved early and in earnest; and our support staff become specialists in their own right.

The Tort Group also has a long history of providing legal opinions on all matters of tort law, including complex coverage issues, priority, and matters with jurisdictional complications. We regularly present as speakers at seminars for the legal profession, the insurance industry, and insured associations as well.

Like our peers in the Accident Benefits group, we have the privilege of representing clients that defend matters on principle. As a result, we not only apply the law, we shape it. The creativity and experience developed are seen in all manner of how we resolve our clients’ issues.
